Agreement

By downloading, installing, or using Give Me 5 (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App.

Weather data disclaimer (important)

Give Me 5 displays weather radar imagery obtained from the National Oceanic and Atmospheric Administration (NOAA) National Weather Service (NWS). This imagery is provided "as-is" and may be delayed, incomplete, incorrect, or unavailable.

You must not use the App for:

• Aviation flight planning or navigation
• Marine navigation or operations
• Severe weather emergency decisions (use NOAA Weather Radio or your local NWS office)
• Storm chasing or any activity where weather error could cause injury
• Search and rescue, emergency response, or first responder operations
• Any commercial decision-making where weather is a critical factor

For safety-of-life decisions, always rely on official NWS warnings, NOAA Weather Radio, local emergency management, and certified weather services. The App is intended for general informational use only.

License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal, non-commercial purposes.

You may not:

• Decompile, reverse engineer, or attempt to extract source code
• Sublicense, sell, rent, or transfer the App to anyone
• Use the App to violate any law or third-party right
• Attempt to circumvent ads, the "Remove Ads" purchase mechanism, or any other monetization feature
• Use automated means (bots, scrapers) to access the App's servers or its third-party data sources

In-app purchases

The App offers a one-time "Remove Ads" purchase. This is:

• Non-consumable — once purchased, the benefit persists across reinstalls on the same Google Play or Apple App Store account
• Non-transferable — purchases cannot be moved between different store accounts
• Subject to store policies — refunds are handled by Google Play or Apple under their respective policies; we cannot process refunds directly

Promo codes occasionally distributed by the developer grant the same entitlement and are subject to the same terms.

Third-party content

The App incorporates content and services from third parties, including:

• NOAA / NWS RIDGE radar imagery (public domain government data)
• Google Maps SDK for the map view
• Google AdMob for advertising
• Firebase services for crash reporting

We do not control third-party content and do not warrant its accuracy or availability. Use of third-party services within the App is also governed by their respective terms.

No warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT WEATHER DATA SHOWN WILL BE ACCURATE, CURRENT, OR COMPLETE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FRITZNET, ITS AFFILIATES, OR THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us for the App in the 12 months preceding the claim (which, for the free version, is $0).

Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the App at any time by uninstalling it.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in California.

Changes to these Terms

We may update these Terms occasionally. The "Last updated" date at the top reflects the latest version. Continued use of the App after changes constitutes acceptance of the updated Terms.
